Supreme Court makes public hearing on 'unlicensed medical practice of nurses'

In two and a half years, the Supreme Court held a public hearing in the sub-judgment case, not the all-aggregate case.

From 2 p.m. today (8th), the Supreme Court held a public hearing on the "Medical Law Violation Case" to argue about whether to conduct unlicensed medical treatment for nurses.

The Asan Social Welfare Foundation instructed the defendants, who are doctors, to collect bone marrow samples necessary for bone marrow examination to a nurse specializing in tumors, but they were charged with violating the medical law.

The prosecution argued that bone marrow examination is a high-level medical practice that only doctors can do, and that specific instructions and supervision by doctors are essential.

On the other hand, Asan Social Welfare Foundation countered that bone marrow examination does not require high-level knowledge and skills because the procedure is simple.

In addition, he stressed that the original judgment that convicted doctors runs counter to the purpose of the recently enacted nursing law and is unfair even in the light of the future of Korean medicine.

This is the fourth public hearing of the Sobu case, and it has been two and a half years since March 2022.

A Supreme Court official said he will continue to try to expand public debate on cases where public attention is focused and social impact is large.
