A soldier who was discharged from the military after suffering from neck disc after performing vehicle maintenance for more than 10 years in poor environment was not recognized as a compensator for veterans.

In the first trial court, the Ministry of Patriots and Veterans Affairs appealed, saying it was not subject to support because it had a causal relationship with the job.

A, who has been in charge of transportation since becoming a non-commissioned officer in the Army in 2006.

In addition to driving military vehicles, I have also done vehicle maintenance myself.

Vehicles in the unit were over 20 years old on average, requiring two or three maintenance every day:
There was no lift to lift the
car, so I had to go underneath the car myself, raise my neck, and maintain it.

After this work, it was a neck disc that returned to Mr. A.

In the end, he completed 14 years of military service properly.

[Mr. A/ Army sergeant discharged from the army: I was daydreamed in the army. It's said that the disk fell out and ruptured. I couldn't hold the pencil in my arm. due to numbness in one's arms]

After that, Mr. A applied for registration as a person eligible for veterans' compensation, but it was not accepted.

Mr. A's job is not directly related to the neck disc.

When the administrative trial was also rejected, A eventually filed a lawsuit, and the first trial court ruled in favor of A.

Based on the military service environment and diagnosis, the court saw that Mr. A had no choice but to continue excessive bending or receding of the back of his neck for a long time.

We also judged that it was reasonable to think that the work affected the occurrence or deterioration of injuries.

[NO PHILIP / Lawyer: Soldiers who are injured in official duties are usually subject to compensation for veterans. (Ministry of Patriots and Veterans Affairs) tends to be a little tricky to examine these areas. Emotional opinion (received) that the onset of degenerative neck disc is significantly causative....]

If you are designated as a recipient of veterans' compensation, you will be able to receive medical support such as medical expenses from the government.

However, with the Ministry of Patriots and Veterans Affairs appealing, Mr. A continued the lawsuit that had been going on for nearly three years.
