A suspended prison sentence has been confirmed for a military officer who beat his subordinates with a riot stick and spoke out.

The Supreme Court upheld the original ruling that sentenced Air Force Major Yoon, who was indicted on charges of special assault and insults, to one year in prison and two years of probation.

Yoon is accused of assaulting his subordinate A with a riot stick or grabbing him by the back of his neck with his hand for about two months from November 2021.

Earlier, Yoon was sentenced to two years in prison and three years of probation in the first trial, but the second trial court reduced his sentence to one year in prison and two years of probation, saying he had no history of punishment and that his family and colleagues were pleading for leniency.

Yoon argued that it was illegal for the court to revise the date and time of the crime at the appeal stage and allow the court to change the indictment, but it was not accepted.

The Supreme Court dismissed the appeal, saying there was no mistake in misunderstanding the legal principles regarding the establishment of special assault crimes in the judgment of the lower court.
