A man in his 60s who killed him with a weapon while fighting with a neighborhood junior who was drinking with him was sentenced to 13 years in prison, heavier than the first trial.

According to the legal community on the 9th, a man in his 60s drank with his neighborhood junior B (63), who was close to him at his home in Hongcheon-gun, Gangwon-do, from 10 a.m. on March 25.A quarrel broke out while continuing the drinking session after moving to

B's house, leading to a physical fight as B held a weapon in his hand. In the process, B's throat was cut once, and A, who took away the weapon, killed B. Mr. A turned himself in to the police about three hours later, and was eventually put on trial in custody.

He claimed in court that B, who misunderstood that he had applied alone and got a job, repeatedly criticized and accidentally committed the crime.

The Chuncheon District Court, which was in charge of the first trial, judged that it was reasonable to say that the victim first raised a weapon and accidentally triggered the crime, but killed him with a definitive criminal intent of murder when he hit the victim with a weapon.

The prosecution demanded a 15-year prison term for A, but the court sentenced him to 10 years in prison, using the circumstances in which A surrendered to an investigative agency immediately after the crime as a special sentencing factor. Accordingly, the prosecution's appeal that "the older brother is light" and A's appeal that "he is heavy" followed.

The Chuncheon District Court of the Seoul High Court, which reviewed the case again, concluded that it is difficult to say that A turned himself in after repenting for his wrongdoing in light of the circumstances in which he attempted to prostitute after taking a taxi to the coffee shop immediately after the crime, and the situation in which he hit a police officer in the neck while moving to the district office after reporting 112.

In addition, it is highly likely that A has already become a strong suspect and A's deoxyribonucleic acid (DNA) was detected in the weapon, so the contribution of A's embroidery is not large, so it should be considered only in a limited way.

On top of that, he was sentenced to 13 years in prison, heavier than the original trial, judging that the crime was quite poor, considering A's statement that "he saw a lot of blood in the victim's throat and thought he could not fix it even if he was taken to a hospital anyway."
