A day job who died while cleaning windows...Court "Acknowledging Worker's Personality"

A court ruled that even daily workers should pay survivors benefits if they are recognized as workers due to the company's instructions or supervision.

The Seoul Administrative Court ruled in favor of the plaintiff in a lawsuit filed by the bereaved family of a daily worker A against the Korea Labor Welfare Corporation to cancel the decision to collect unfair gains.

The court judged that A was a worker subject to the Industrial Accident Insurance Act, saying that it is recognized that A was a person who provided work for the purpose of wages to the company.

Mr. A fell to his death in June 2021 when a line broke while cleaning windows as a daily job.

Since then, A's bereaved family has requested the Korea Workers' Compensation and Welfare Corporation to receive survivors' benefits, but when the corporation belatedly requested the return on the grounds that it was a daily job, the bereaved family filed a lawsuit.
