As Lee Jae-myung of the Democratic Party of Korea was sentenced to a heavier-than-expected ruling in a trial for violating the Public Official Election Act, the attention of the political community is focused on the results of the first trial of perjury teacher charges on the 25th.

The ruling party claims that the arrest motion on the same charges has already been passed last year and that Lee could be arrested without a separate procedure, but the Democratic Party of Korea countered that it should go through another vote on the arrest motion by the National Assembly.

In September last year, a motion to arrest Lee Jae-myung, chairman of the Democratic Party of Korea, was passed by the National Assembly plenary session, which was requested for an arrest warrant on charges of perjury and other charges.

Except in the case of a current offender, an incumbent lawmaker needs the consent of the National Assembly to be arrested or detained in the middle of the session,
The approval of the
arrest motion led to Lee's review of the warrant, but the warrant was rejected and the arrest crisis was avoided.

As representative Lee's judicial risk became a reality due to the first trial's violation of the Public Official Election Act, the People's Power, which launched a massive offensive, recalled the arrest motion last year ahead of the first trial of the perjury teacher.

Since the previous motion for arrest of the same charges has already passed the National Assembly, if a court ruling is issued, additional arrests can be made without the consent of the National Assembly.

Han Dong-hoon stressed that the perjury teacher case is included in the arrest motion that passed the National Assembly last year.

Joo Jin-woo, chairman of the party's legal advisory committee, also helped that when Chung Chan-min was arrested in court in the 21st National Assembly, the arrest agreement was passed earlier and the court did not demand it additionally.

Democratic Party, however, refuted that the approval of the arrest agreement was the 21st, and that the National Assembly's session changed and the National Assembly's judgment was needed again.

In a call with YTN, a member of the party's prosecution's anti-dictatorship committee explained that unlike the last National Assembly, the composition of the 22nd member has changed and the arrest warrant has been rejected, so it cannot be considered effective until now.

The ruling party's emphasis on the possibility of Lee's arrest seems to be based on the judgment that the trial sentence for perjury teachers will be heavier than the violation of the Public Official Election Act.

The Democratic Party of Korea, which has been struggling to hide its embarrassment since the first trial was sentenced, is also paying attention to the outcome of the sentence on the 25th.
