The Seoul High Prosecutors' Office recently allocated a case to the Criminal Department in which former Democratic Party lawmaker Choi Kang-wook appealed against the prosecution's non-prosecution against First Lady Kim.
The Criminal Department plans to review the appeals and investigation records handed over by the Seoul Central District Prosecutors' Office and decide whether to order a reinvestigation.
As the case moves to the Seoul High Prosecutor's Office, Prosecutor General Shim Woo-jung will lead the investigation.
The Seoul High Prosecutor's Office may order the lower prosecutor's office to investigate again if it is determined that there is anything insufficient or additional to investigate.
Previously, President Shim said in a parliamentary audit last month that he would exercise his right to command the investigation if the accuser appeals the case against Mrs. Kim.
Earlier, after more than four years of investigation, the prosecution did not indict Kim Gun-hee last month, saying she was not aware of former Deutsche Motors chairman Kwon Oh-soo's manipulation of the market price.
