Martial law is divided into emergency martial law and security martial law.
Emergency martial law can be declared by the President when the social order is extremely disturbed by wartime, events, or equivalent national emergencies, making it significantly difficult to perform administrative and judicial functions.
A weaker security protocol can be declared to maintain public well-being in cases where general administrative agencies alone cannot secure security.
All martial law can be proposed by the Minister of Defense or the Minister of Public Administration and Security to the President through the Prime Minister, and the President must go through the deliberation of the State Council when declaring martial law.
In addition, when declaring martial law, the reason and type, the implementation area, and the martial law commander must be announced.
When the president declares martial law, he should notify the National Assembly immediately.
When emergency martial law is declared, the martial law commander is in charge of all administrative and judicial affairs.
The martial law commander may take special measures against arrest and detention, media, publication, assembly and association activities when necessary for military purposes.
In modern Korean history, martial law was first declared during the Yeosun Incident in 1948, and Park Chung-hee and Chun Doo-hwan, who staged a military coup on May 16, declared it to take power.
