Police investigating the December 3 martial law incident launched a search and seizure of the presidential office, but failed to proceed with the search and seizure as they confronted the security office. Police explain that they have received only a small portion of the data from the presidential office, but after reviewing the data, they are expected to decide whether to try the seizure and search again.Let's point out with Youngsoo Kim reporter from the Ministry of Social Affairs today. Please come in. From the police's point of view, they must have tried because they had a search warrant, but what should be the reason for the difficulty now?

[Reporter]
As the reporter explained earlier, I'll give you a brief overview first. I arrived at the presidential office's civil service office at around 11:40 a.m. today for a raid. Of course, there must have been a warrant. So, it was an attempt to search and seizure, but this warrant was specified as the subject of seizure and search, including the Presidential Office, the State Council, the Security Service, and the Office of the Martial Law Command. However, Hannam-dong's official residence was not included in the search and seizure. It was found that President Yoon Suk Yeol was indicated as a suspect in this warrant. However, even though I took this warrant, the search and seizure could not proceed due to confrontation with the security service. The police personally went into the presidential office and discussed whether to conduct a search and seizure or receive a random submission of data. If you look at it in the past, this has happened. When former President Park Geun Hye was investigated during the Blue House, he received data in the form of voluntary submission. At that time, there was also a search warrant. So, after a long discussion, the police received the data. However, from the police's point of view, they received the data by voluntary submission, and they believe that it is only a small part of it. So, they will review this data again and decide whether to conduct additional seizure and search.

What data are the police trying to secure through the raid?

[Reporter]
First of all, I think it will be important to secure data related to the State Council that deliberated on the declaration of emergency martial law. But if you look at the contents of the Ministry of Public Administration and Security. There was a Cabinet meeting on the 3rd to declare emergency martial law. There seems to be no minutes of the meeting on the 3rd. He said that he did not have the gist of his remarks when he disclosed the data he received after requesting the presidential secretary's office. It's written like this, so there's a possibility that there's no minutes. A statement supporting this came from the National Assembly. Justice Minister Park Sung-jae remembered that there was no one recording anything at the time at the National Assembly. Prime Minister Han Deok-soo also replied to the effect that the Cabinet meeting, which declared emergency martial law, did not go through proper procedures on the 3rd.

Also, who wrote the decree regarding the decree is also interested in this part.

[Reporter]
That's right. It contained a ban on political action. There is also an analysis that this decree is important evidence of civil war. At first, there was a situation in which the Defense Security Command prepared this. However, former Minister Kim Yong-hyun reportedly stated in the prosecution investigation that he wrote it and corrected it by President Yoon Suk Yeol. The police are likely to find traces of the decree if they conduct a raid on the office. I think you'll find traces of it, whether you've drafted it yourself or modified it.

Do you think there is a possibility that the police, who are speeding up their investigation into President Yoon Suk Yeol, will be arrested like former Minister Kim Yong-hyun?

[Reporter]
First of all, it seems that Oh Dong-woon, the head of the Senior Civil Servant Corruption Investigations Unit, expressed some willingness. The National Assembly mentioned that it would attempt to arrest the president by warrant. Of course, opposition lawmakers asked a lot of questions. That's why it came out in the process of answering, but we have to wait and see how likely this is. The requirements for an emergency arrest are in the Criminal Procedure Act, and there should be considerable reason to suspect the death penalty, life imprisonment or imprisonment for a long period of more than three years. It stipulates that when there is no time to obtain an arrest warrant, when there is a fear of destroying evidence, and when there is a fear of running away or running away. In the case of rebellion, the head's case is treated as a very heavy sentence with the death penalty, life imprisonment, and imprisonment. However, it seems that this is a part that needs to be judged by investigative agencies because it is not just done with sentences.

You summarized the emergency arrest requirements, but the police chief, Jo Ji-ho, and the Seoul police chief, Kim Bong-sik, have now been arrested.

[Reporter]
That's right. This is the second and third cases of emergency arrest in connection with the martial law crisis. Earlier, former Defense Minister Kim Yong-hyun was arrested urgently. It's a similar case. Yesterday, Police Commissioner Jo Ji-ho and Seoul Police Commissioner Kim Bong-sik attended the police and were questioned. After being investigated, the police immediately arrested the pair early this morning. The two are accused of blocking the National Assembly after martial law was declared. It's a charge of rebellion. on the charge of rebellion In the case of Commissioner Jo Ji-ho, he was previously listed as an accomplice in the arrest warrant for former Minister Kim Yong-hyun. Separately, the police have notified the members of the State Council and the members of the State Council who attended the Cabinet meeting.

In the midst of this, former Minister Kim Yong-hyun made an extreme choice at the detention center. What was the situation with this report?

[Reporter]
Reporter Kim Tae-won organized it well, but this was also mentioned at the National Assembly today. Chairman Chung Chung-rae and Chairman of the Judiciary Committee confirmed this to the head of the correctional headquarters. Former Minister Kim Yong-hyun was asked for an arrest warrant, so there was a warrant review yesterday. But I didn't give up and go out. So I was waiting in the detention center. I think it was just before the warrant was issued. They tried to make an extreme choice in the bathroom and the scene was found by an employee in the control room. So former Minister Kim Yong-hyun gave up and came out. It has been confirmed that there is no health problem. And given that they responded to the prosecution's summons, there seems to be no major health problems.

[Anchor]
With the issuance of an arrest warrant for former Minister Kim Yong-hyun, wasn't there a judgment on the scope of the prosecution's investigation?

[Reporter]
The reason why the warrant was issued was that the degree of clarification of the crime, the seriousness, and the concern of destroying evidence were considered. The court has specified how far the prosecution's investigation is possible. It was judged that the prosecutor was within the scope of the crime that could be initiated by the investigation, regarding the arrest warrant for former Minister Kim Yong-hyun. Perhaps it was effective to point out National Police Agency Commissioner Jo Ji-ho as an accomplice. Originally, there were many predictions that the prosecution would investigate the crime of rebellion through charges of abuse of authority, but it seems that the prosecution explained a lot to the court that the prosecution could investigate the police. According to Article 4 of the Prosecutor's Office Act, the prosecution has allowed the prosecution to investigate police officials and public officials in the Senior Civil Servant Corruption Investigations Unit. Therefore, the prosecution seems to have continued to investigate former Minister Kim Yong-hyun by writing Cho Ji-ho, the head of the National Police Agency, as an accomplice. And the prosecution must have gained momentum because it arrested former Minister Kim Yong-hyun. We have increased the size of the special edition. We sent 5 more prosecutors and 10 more investigators. So the number of prosecutors has increased to a total of 25.

[Anchor]
Nevertheless, the subject of the investigation has not yet been organized. The Joint Investigation Headquarters has been launched?

[Reporter]
That's right. The police, the Senior Civil Servant Corruption Investigations Unit, and the Ministry of National Defense have formed a joint investigation headquarters. According to the explanation, it is a measure to investigate quickly and efficiently. In the case of the police's investigation capabilities and the Senior Civil Servant Corruption Investigations Unit, the prosecution has the right to claim a warrant. I think I will use it as a strength, and in the case of the Ministry of National Defense, I said I would cooperate by utilizing my military expertise. It is not yet known how large this will be, but in the case of the police, about 150 investigators are currently being deployed, so it is expected to be well over 100. In the meantime, there has been a lot of controversy due to the overlapping investigation. That's why the move came out, but as you can see, the prosecution is out here.

[Anchor]
That's what I'm saying. So the prosecution decided not to participate in the collaboration? What's going on?

[Reporter]
As far as we know, there seems to have been no suggestion to the prosecution at all. Our reporters asked the prosecution official, but he replied that he had not been contacted about the launch of the collaboration, and that he understood after seeing the media. So I think I'll have to check this out next time. However, I think there will be a separate consultation after that. I think the prosecution needs to think about whether or not to participate in this. However, the prosecution has been dispatched by military prosecutors to investigate. So, we are speeding up the military-related investigation, and 12 military prosecutors are likely to continue the investigation with the prosecution.

[Anchor]
I see. I've been a reporter for the Youngsoo Kim of the Ministry of Social Affairs. Thank you.
