The Supreme Court sent the case back to the Seoul Eastern District Court today (12th), breaking the original court that sentenced the Asan Social Welfare Foundation to a fine of 20 million won for violating the medical law.
The Supreme Court saw that bone marrow examination is not a medical practice that only doctors can do, but a medical practice that can be ordered to nurses under the guidance and supervision of doctors.
The Asan Social Welfare Foundation was accused of violating the medical law by having professors at Asan Medical Center under the Asan Medical Center collect bone marrow samples from nurses in 2018.
Earlier, the first trial acquitted him and the second trial convicted him.
