Shortly after the declaration of the emergency martial law, it was argued that an incumbent judge who acquitted Lee Jae-myung of the Democratic Party of Korea was included in the list where the military demanded the police to track the location.
The Supreme Court protested that if true, it was a serious violation of the jurisdiction, as stated by the lawyer of the National Police Agency, Cho Ji-ho.

Following the declaration of the emergency martial law, Yeo In-hyeong, the head of the counterintelligence command, asked Hong Jang-won, the former first deputy chief of the NIS, and Jo Ji-ho, the police chief, to track the location of the arrest of key figures.
About 10 political and political figures, including People's Power Party Chairman Han Dong-hoon, Democratic Party Chairman Lee Jae-myung, and National Assembly Speaker Woo Won-sik, were arrested.
However, the National Police Agency Commissioner Jo Ji-ho claimed that the list included incumbent Judge Kim Dong-hyun of the Seoul Central District Court.
Judge Kim is a judge who acquitted Lee Jae-myung of the Democratic Party of Korea's "perjury teacher" on the 25th of last month, and is also in charge of hearing Lee's key judicial risk, "Daejang-dong and Baekhyun-dong Suspicions."
Cho's lawyers said when Cho, who answered the phone to Commander Yeo In-hyeong at the time, asked who he was because he was a stranger, he reaffirmed that he was a judge who acquitted Lee's perjury teacher case.
As suspicions arose that an incumbent judge attempted to arrest former Supreme Court Chief Justice Kim Myung-soo and former Supreme Court Justice Kwon Soon-il, the Supreme Court and the Central District Court immediately protested that it should never occur in a rule of law.
If Cho's claim is true, he stressed that it is a direct and serious violation of the jurisdiction, and that prompt fact-finding and strict legal responsibility should be followed.
However, the police special investigation team said that Cho did not make a direct statement in the investigation, and that it will continue to check related suspicions.Amid questions about whether President Yoon
tried to neutralize the legislature as well as the judiciary, whether the incumbent judge was the subject of arrest is expected to be a major issue in future investigations.
