With the execution of an arrest warrant for Yoon Suk Yeol's president imminent, the response of the presidential security service has become the biggest variable.
Interrupting the execution of a warrant could lead to a charge of obstructing the execution of public affairs, and violating the presidential security order could be a reason for disciplinary action, putting him in a dilemma.
Reporter Shin Ji-won reports.
[Reporter]
the day after the arrest and search warrant for President Yoon Suk Yeol was issued,
Oh Dong-woon, head of the Criminal Investigation Department for high-ranking government officials, sent a warning letter to the Presidential Security Service.
[Dongwoon Oh / Senior Civil Servant Crime Investigation Director (last 1st): Locking the barricades, the iron doors, and refusing to comply with our arrest warrant itself is a hindrance to the execution of official duties]
All the presidential security officials are national officials.
Article 33 of the National Public Officials Act applies as reasons for disqualification,
If a sentence of
probation or higher is confirmed, you may lose your status as a public official or face pension disadvantages such as reduction of retirement benefits.
In particular, when looking at the allegations of 'interference in the execution of special public affairs' mentioned in the warning letter of the Senior Civil Servant Corruption Investigations Unit,
If the
Police Department injures a public official belonging to the Senior Civil Servant Corruption Investigations Unit or a police officer in the process of preventing the execution of a warrant, he or she can be sentenced to more than three years in prison without a fine.
On the contrary, if you violate the order of the bodyguard to protect President Yoon, it could lead to internal disciplinary action.
The bodyguard still maintains its official position that it can restrict the execution of search and arrest warrants to maintain military and official secrets.
However, even if you violate the order of the security service, there is room for dispute as to whether cooperating with the arrest warrant issued by the court constitutes a legitimate reason for disciplinary action.
Eventually, the security officials were in a position to take the risk of a criminal case and follow the instructions of the security service or cooperate with the Senior Civil Servant Corruption Investigations Unit under the arrest warrant.
