Kim is accused of pre-empting emergency martial law by gathering with former intelligence commander Roh Sang-won at a hamburger store in Ansan-si, Gyeonggi-do.

Prosecutors believe former Colonel Kim participated in the occupation of the National Election Commission and the arrest of key employees on the day of martial law.

It was also found that it was trying to create a separate investigation team that included reservists in the joint investigation team of the counterintelligence command to be set up after martial law.Former Colonel

Kim was discharged from the military in disgrace in 2018, when he served as the head of the investigation division at the Ministry of National Defense, and was sentenced to 10 months in prison for reducing the case of commentary by the Lee Myung Bak government's Cyber Command.
