On the day of the December 3 emergency martial law, the police denied allegations that the National Investigation Headquarters had received a request for support from the Defense Security Command and even knew the specific list.

The National Police Agency explained in a media announcement that Police Commissioner Jo Ji-ho and others have not been briefed on the list of arrests.

At the same time, the head of the investigation planning department of the National Police Agency also explained that he had never been told by the counterintelligence agency to arrest Lee Jae-myung and Han Dong-hoon.

The police said that the charges were written by the prosecution by adopting only the statements of the counterintelligence agent, and that they were different from the facts.

Earlier, the prosecution stated in Cho's indictment that the head of the National Police Agency's investigation planning department and the head of the counterintelligence agency's investigation coordination department spoke twice on the day of martial law, and in the process, a specific list of arrests was mentioned and even reported to Cho.
