While the high-ranking government official's criminal investigation office has requested an arrest warrant for President Yoon Suk Yeol, an incumbent judge has questioned whether he has the right to investigate rebellion at the Senior Civil Servant Corruption Investigations Unit.

Judge Baek, a Supreme Court justice, posted on the court's internal network yesterday morning about whether the Senior Civil Servant Corruption Investigations Unit can investigate the abuse of authority that does not constitute a civil war or foreign exchange crime under Article 84 of the Constitution and whether the crime of civil war is subject to investigation under the Senior Civil Servant Corruption Investigations Unit Act.

Judge Baek first pointed out that if a forced investigation is conducted for abuse of authority, which cannot be prosecuted under his personal understanding, "the forced investigation itself will become ineffective due to conflict with Article 84 of the Constitution."

"If we believe that the crime of abuse of authority may be absorbed into the crime of rebellion, I think it is a contradictory logic in that it will result in an investigation into the crime of rebellion, not the authority of the Senior Civil Servant Corruption Investigations Unit in the name of related crimes," he added. "I hope the court's discussions on the process that has been accumulated so far will be preserved."
