The lawyers for acting president Choi Sang-mok answered the Constitutional Court to the effect that the acting president also has the right to appoint constitutional judges recommended by the National Assembly, including Ma Eun-hyuk.

An official from the Ministry of Strategy and Finance told YTN that it has submitted a 68-page response to the Constitutional Court, which includes the purpose of the Constitutional Petition on the Non-appointment of Judges, filed by lawyer Dodam Kim Jung-hwan of the law firm.

In the response, Acting Chief Justice Choi Sang-mok claimed that all three candidates for the National Assembly's recommendation of judges exercised their right to appoint, that is, to act, and that judges Cho Han-chang and Jeong Hyun-sun had already done it, but Ma Eun-hyuk was also being appointed if the ruling and opposition parties agreed.

To this end, it was found that he introduced cases from various countries and argued that the acting president also had passive discretion regarding the appointment.

Earlier, lawyer Kim Jung-hwan filed a constitutional complaint against a candidate for a judge elected by the National Assembly, saying that the president or acting president's actual right to appoint him violates the separation of powers by interpreting the right to appoint too broadly.
