Today (21st), Judge Choi Young of the Busan District Court's Civil Division 3 announced that he has confirmed the plaintiff's victory in a lawsuit filed by the victim against the perpetrator Lee for 100 million won in damages.
In the course of the lawsuit, the court judged that defendant Lee admitted the plaintiff's claim because he never attended court and did not submit an opinion, and cited all of the plaintiff's claims.
Lee filed an appeal against this, but was served with the order to dismiss the complaint because he did not pay the stamp and service fee required for the appeal. Within 14 days after the order of dismissal of the appeal letter was reached, the appeal notice and service fee were not paid or the appeal was not re-submitted, and no immediate appeal was filed against the order of dismissal.
However, due to the nature of civil lawsuits, actual seizure or execution may not be easy if the defendant's property is not present even in the final judgment of compensation.
Lee was charged with trying to beat the victim to death at the officetel joint hall after chasing him for about 10 minutes with the aim of sexually assaulting the victim returning from Seomyeon, Busanjin-gu, at 5 a.m. on May 22, 2022, and the Supreme Court confirmed a 20-year prison sentence. Later, Lee's attempted murder charge, which was applied in the first trial, was changed to attempted rape and murder at the appeal trial.
