The Seoul Administrative Court rejected a lawsuit filed by spokesman Lee, the deputy prosecutor of the Daegu District Prosecutors' Office, against the Minister of Justice to invalidate the reinstatement order.
The court reportedly decided that the Justice Ministry's Prosecutor's Disciplinary Committee voted to dismiss spokesman Lee last month and that there was no benefit in the lawsuit to determine the effectiveness of the reinstatement order as related procedures were carried out.
Earlier, spokesman Lee submitted his resignation to run for the general election in March, but the Ministry of Justice refused to accept Lee on the grounds that he is on trial in the case of former Vice Justice Minister Kim Hak-ui's illegal departure ban.
After applying for a leave of absence from the disease, Lee ran for the general election as the 22nd proportional representative of the Cho Kuk Innovation Party as an incumbent prosecutor in April and was dropped, and served as a spokesperson for the same party.
The Justice Department ordered reinstatement at the end of the illness leave period, but the spokesman objected and filed an annulment suit in April.
