The National Assembly's Legislative Investigation Office says the impeachment motion of Prime Minister Han Deok-soo, who is acting as the president, has 151 quorum to be voted on by the National Assembly.

In an answer to the office of Kim Han-kyu of the Democratic Party of Korea, the Legislative Investigation Office explained that there is no theory that the requirements for impeachment of the prime minister apply if a reason for impeachment occurs while performing his duties as an acting prime minister before taking office.

The Constitution stipulates that the quorum of impeachment decisions by members of the State Council, excluding the president, is 151, which is a majority of the registered members, and in the case of the president, two-thirds of the registered members, or more than 200, are in favor.

The Democratic Party of Korea is considering proposing an impeachment motion, saying that Han will postpone the promulgation of the independent counsel law and the Kim Gun-hee independent counsel law, but plans to include only criminal charges when he was prime minister.

The Legislative Investigation Office also interpreted in its response to Lee In-young's office of the Democratic Party that the acting president can appoint a special prosecutor if the purpose is to restore the constitutional order.

However, he added that it is a general view that the exercise of the right to request reconsideration of the bill should be refrained unless there is a very special reason, and that no new state councilor or agency head should be appointed.
