The prosecution's indictment contains circumstantial evidence that the National Investigation Headquarters of the police, which received a request for support from the Defense Security Command for arrest on the day of the emergency martial law in December last year, received a list of people subject to arrest.

According to the indictment of Police Commissioner Jo Ji-ho and Seoul Metropolitan Police Commissioner Kim Bong-sik, which was submitted by Democratic Party lawmaker Kim Yong-min from the Ministry of Justice, Lee Hyun-il, head of the investigation planning department, and Koo In-hoe, head of the investigation coordination department of the counterintelligence agency, spoke twice for 20 minutes from 11:32 p.m. on the day of martial law.

At the time, Chief Lee asked "who are you arresting" at the request of Chief Koo to send 100 police personnel and 20 convoys to the National Assembly, and Chief Koo answered "Han Dong-hoon, representative Lee Jae-myung."

Afterwards, he reported to Director Jo Ji-ho through an investigation planning coordinator that "support five members of Han Dong-hoon's arrest team," and also reported to Director Woo Jong-soo of the National Investigation Headquarters that he requested support for counterintelligence agents and reported the related list to Director Cho.

The special investigation headquarters of the prosecution's emergency martial law judged that Commissioner Cho aided and abetted the illegal arrest support request for politicians without any action.
