The Senior Civil Servant Corruption Investigations Unit and the President of Yoon Suk Yeol have clashed again over whether to arrest the first sitting president.
At the Senior Civil Servant Corruption Investigations Unit, Cha Jung-hyun and other prosecutors who led the investigation of the case will appear at the Seoul Western District Court.
It plans to emphasize the allegations that President Yoon led the civil war by mobilizing the military and police to block the National Assembly and putting martial law troops into the NEC.
Although there was only one face-to-face investigation, more than 1,500 pages of investigation data were also secured to prove President Yoon's actions before and after martial law, including the military general's newspaper report.
In addition, he plans to persuade the court that arrest is inevitable because he refused to comply with the request for a legitimate summons, prevented the execution of arrest warrants, and did not cooperate with the investigation.
In response, Yoon's side will be fully defended by senior and junior lawyers, including Yoon Gap-geun and Bae Jin-han.
President Yoon is expected to deny that he did not issue an unconstitutional order, citing the argument that martial law declaration cannot be subject to judicial review as an act of governance.
It is also expected to highlight the jurisdiction issue that the Senior Civil Servant Corruption Investigations Unit, which does not have the right to investigate, is committing illegal acts and is shopping for warrants in the Western District Court, not the Central District Court.
