The Seoul High Court made the decision after resuming prosecutor Sohn's appeal hearing yesterday and proceeding with the trial date.
At the hearing, the court focused on prosecutor Sohn's alleged violation of the Public Official Election Act, which was added by the High-ranking Public Officials Crime Bureau in the second trial.
The Senior Civil Servant Corruption Investigations Unit argued that prosecutor Sohn and former lawmaker Kim Woong of the People's Power could be found guilty even if they were not proved to be colluded.
On the other hand, prosecutor Sohn countered that if there was no collusion with former lawmaker Kim, it could not be considered to have affected the election.
Prosecutor Sohn was charged with trying to influence the election by sending a complaint against the then ruling party personnel, including writer Rhyu Si-min, to former lawmaker Kim ahead of the 2020 general election.
In January, the first trial court convicted prosecutor Son of leaking official secrets and sentenced him to one year in prison.
