"To sue, go to court in Hong Kong and Singapore..." Ali and Temu uncovered 47 unfair terms and conditions

Chinese direct purchase platforms Ali and Temu have been caught by the Fair Trade Commission for operating unfair terms and conditions that infringe on consumers' rights, including excessive immunity and the use of personal information.

The FTC said its review of AliExpress and Temu's terms and conditions led to the discovery and correction of 47 unfair terms and conditions of 13 types.

The terms and conditions in question included provisions that do not take responsibility in any case or unfairly collect and utilize users' personal information, and provisions that set foreign courts such as Hong Kong and Singapore as jurisdictions in case of disputes.

The FTC said the move made it clear that foreign operators must meet at least domestic-level consumer protection obligations and comply with domestic laws and regulations if they want to operate with domestic consumers.

The Fair Trade Commission predicted that the application of the revised terms and conditions will be possible this week, and Temu will not be able to do so until early next month as its Singapore subsidiary manages the terms and conditions.
