A court ruled that it was illegal for the district office to remove a banner from the progressive party urging an investigation into Kim Gun-hee.

The Seoul Administrative Court ruled in favor of the plaintiff in a lawsuit filed by the Progressive Party against the head of Songpa-gu and the head of Seodaemun-gu to cancel the removal of the party banner.

Earlier, Songpa-gu Office and Seodaemun-gu Office removed banners calling for an investigation into Kim Gun-hee posted on the street by the Progressive Party in January.

At that time, the district office judged that the banner violated the Seoul Metropolitan Government's ordinance that it should not slander or insult a specific person by marking his or her real name.

However, the court said the ordinance violates the principle of superiority, and explained that the ordinance cannot be used as a basis for disposition because it does not conform to the Outdoor Advertisement Act, a higher law.

He added that the Outdoor Advertisement Act does not mandate that matters related to party banners can be determined by ordinance, which is a subordinate statute.
