Human Rights Commission Says No Human Rights Violation Of Martial Law

When asked about the unconstitutionality of the Dec. 3 emergency martial law declaration, the National Human Rights Commission gave only a theoretical answer that violating the Constitution would lead to human rights violations.

In a document submitted to the office of Rep. Seo Mi-hwa of the Democratic Party of Korea, the National Human Rights Commission did not reveal its position on the unconstitutionality of decree 1.

Instead, the commission added that it had issued a statement saying that all state powers should be exercised fairly and justly in a way that is acceptable to the people in due process.

Referring to Article 77 of the Constitution, the President said martial law can be declared in accordance with the law in a national emergency, and he explained that violations of the regulations would result in human rights violations.
