The Seoul Central District Court today (16th) held the first trial preparation date for former Minister Kim, who is accused of obstructing the exercise of rights to abuse his authority and working as a civil war mission worker.
Former Minister Kim claimed that the declaration of martial law and the series of processes before and after it were the president's exercise of constitutional authority, not a crime, and that the defense minister also exercised his usual duties.
He also stressed that the judiciary has no right to judge whether a prosecutor is right or wrong about the president's constitutional authority, political judgment, and the requirement to declare emergency martial law, which is the exercise of governance.
On the other hand, the prosecution refuted that the Supreme Court's firm attitude is that if the act of expanding emergency martial law is a crime, it will be subject to judicial review.
He then explained that there are 28 cases of evidence in the former minister Kim's case, and if he does not agree to use the statement and the suspect's interrogation report as evidence, there will be 5 to 60 witnesses to apply.
Meanwhile, the court designated former Minister Kim's second trial preparation date at 4 p.m. on the 6th of next month.
